Terms of Service

1. Acceptance of Terms
By accessing or using the Mubeen Holding wholesale marketplace (“Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. These terms apply to all visitors, registered users, and trade buyers.
2. Eligibility and Account Registration
The Platform is a B2B wholesale marketplace. To place orders, you must be a registered business entity in Australia, complete the trade account application and receive approval from Mubeen Holding, provide accurate and complete business information during registration, and be at least 18 years of age and authorised to act on behalf of your business. We reserve the right to reject any application or suspend any account at our discretion.
3. Orders and Pricing
All prices displayed on the Platform are in Australian Dollars (AUD) and exclude GST unless otherwise stated. Minimum order quantities (MOQ) apply to all products as indicated. We reserve the right to change prices at any time without notice. An order is only confirmed once you receive a written order confirmation from us. We reserve the right to cancel or refuse any order.
4. Payment Terms
Payment terms are assigned to each approved trade account and may include Net 30, Net 60, or other arrangements as agreed. Invoices must be paid by the due date. Late payments may incur interest charges and may result in account suspension. We accept bank transfer and other payment methods as specified on your invoice.
5. Delivery and Risk
Delivery timeframes are estimates only and are not guaranteed. Risk of loss or damage to goods passes to you upon delivery. You are responsible for inspecting goods upon receipt and notifying us of any damage or discrepancies within 48 hours of delivery.
6. Returns and Refunds
Returns are accepted only for goods that are defective, damaged in transit, or incorrectly supplied. You must notify us within 7 days of receipt. Returns require prior written authorisation. Change-of-mind returns are not accepted. Refunds or replacements will be issued at our discretion following inspection of returned goods.
7. Intellectual Property
All content on the Platform, including product images, descriptions, logos, and software, is the property of Mubeen Holding PTY LTD or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Mubeen Holding PTY LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or purchase of goods. Our total liability shall not exceed the value of the order giving rise to the claim.
9. Prohibited Conduct
You must not use the Platform for any unlawful purpose or in violation of these terms, attempt to gain unauthorised access to any part of the Platform, resell products purchased from us without prior written agreement, provide false or misleading information during registration or ordering, or interfere with the operation of the Platform or other users' access.
10. Termination
We may suspend or terminate your account at any time for breach of these terms, non-payment, or any other reason at our discretion. Upon termination, your right to access the Platform ceases immediately. Outstanding invoices remain payable.
11. Governing Law
These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
12. Changes to Terms
We may update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms. We will notify registered users of material changes via email.
